Sale's terms and conditions

1. Supplier and applicable regulations

www.odbmagneti.com is owned by ODB srl.

The contractual relationship between the company "ODB srl" (hereinafter supplier) and the Customer is governed, in addition to Italian law, by these General Sales Conditions in effect at the time of the order. The inclusion of the Customer's personal clauses is not allowed, unless expressly confirmed by the supplier.

2. Sale's general conditions

These general conditions of sale are intended to be examined and accepted in full by the Customer at the time of his online order confirmation or as an e-mail message to the supplier.

3. Sales contract

a- The descriptions of the products contained in the supplier's online shop are aimed at the presentation of the purchase proposal by the customer.

b- The Customer can submit the purchase proposal via the Supplier's online order form or by e-mail. Using the online form, the customer, after entering the selected products in the virtual shopping cart and completing the order process by clicking on the Order Confirmation button, submits a legally binding contract offer regarding the products contained in the shopping cart.

c- The supplier can accept the customer's purchase proposal, who will receive a summary of the order placed in writing as an e-mail message, which he must confirm to the supplier.

d- All items on the online site are usually available for prompt delivery..

e- In the event that the items ordered are not available, the supplier will notify the customer of the available products, the delivery times of the unavailable material, inform him of the possibility of making a partial delivery of the order or of the refund of the amount paid, which will be made within 30 (thirty) working days.

f- Order processing and communications are usually done by e-mail. The customer must ensure that the e-mail address indicated to the supplier for order processing is correct, so that the e-mails sent by the supplier to this address can be received.

g- The supply contract is considered fulfilled with the taking over of the goods by the carrier or the recipient.

h- The conditions of sale are valid for furniture on the national territory.

4. Prices

The prices indicated are VAT excluded.

Any additional shipping costs are expressly indicated in the corresponding product description.

5. Minimum order quantity

The minimum order amount is € 15.00 (excluding VAT and shipping costs).

6. Payment terms

Payment of purchases made on the website www.odbmagneti.com can be made in the following ways:

a- Credit Card.

b- Bank transfer at order.The Customer will receive an e-mail with the exact amount to be paid and all the data necessary to make the transfer to the account of the Crédit Agricole institution in the name of ODB srl, IBAN IT52X0623050680000015032332, BIC codes CRPPIT2PXXX.The amount requested will always and only be that relating to the products actually ordered and available. The customer will send the receipt of the bank transfer by e-mail to vendite@odbmagneti.com. The goods will be sent only after receipt of the credit.

c- cash on delivery (only for Italy). The payment must be made directly to the courier upon delivery. The Cash on Delivery is subject to the following conditions: it must be made exclusively in cash (bank or cashier's checks are not accepted) directly to the courier upon delivery. The courier only accepts exact sums, corresponding to the amount of the order. The fulfillment of the order with cash on delivery will only take place at the time of the availability of all the goods present in the purchase order.

7. Shipping costs and delivery time

The purchased products will be shipped by the Supplier to the address indicated by the Customer.

Product deliveries will take place during all working days. The couriers used do not make preventive phone calls or handle requests for shipments at particular times.

Indicatively, without this implying any constraint for the Supplier and subject to the availability of the products, in addition to any causes of force majeure, the goods will be delivered to the courier within 3 days from the first working day following the date of the confirmed order. in the case of payment by credit card or payment by cash on delivery to the courier.

With payment by bank transfer, the shipment will take place after the payment has been credited to the Supplier's current account.

Delivery times and related costs from product availability, shipping methods and the chosen carrier.

With reference to shipments, delivery times and related costs, the main conditions are listed below:

a- Express courier only for delivery in Italy, excluding minor islands: 36-48 hours in working days cost: € 10 including VAT, up to € 150 of expenditure.

b- Express courier for smaller Italian islands: 36-48 hours in working days cost € 37 including VAT.

c- Express courier for delivery in Italy, excluding minor islands: 36-48 hours in working days, transport cost included for orders over € 150.

d- Courier for delivery in Italy for loads over 100 kg: 3-4 working days, cost to be communicated to the customer.

Delivery times are indicative so the supplier assumes no responsibility for any non-punctual delivery.

Packages are properly prepared and sealed with adhesive tape.

The Customer is required to verify that the packaging is intact, not damaged or wet or otherwise altered, even in the sealing materials (adhesive tape or plastic straps).

Only after this verification will the customer have to accept the delivery, after which he will not be able to make any objection about the characteristics of the packaging delivered to him, in relation to the order placed. In the event that the package does not comply with the above, according to the aforementioned methods, the Customer must raise the dispute directly to the carrier and communicate to the Supplier what is disputed at info@odbmagneti.com

8. Products use

Before using the magnetic products, the Customer must read the NOTES FOR THE USE OF MAGNETS on the site.

The Supplier declines all responsibility for damage or injury caused to the Customer or to third parties as a result of improper or careless use of the magnets. By purchasing the magnets, the Customer confirms that he has read and acknowledged the NOTES FOR THE USE OF MAGNETS. For greater security, an information sheet containing a copy of these warnings will be attached to each delivery.

9. Warranty

The goods supplied are guaranteed as established by the current Italian legislation.

The supplier guarantees the quality of the products supplied and in particular their magnetic properties. Damage resulting from improper use of the magnets or intrinsic defects of the magnet itself are excluded from the warranty and cannot be considered a reason for returning or replacing the product.

Is included:

For Neodymium magnets: flaking and abrasion of the coating, shattering or chipping of the magnets, loss of magnetization following exposure to temperatures above 80˚C.

For Ferrite magnets: thin cracks or jagged edges, loss of magnetization following exposure to temperatures above 250˚C, demagnetization due to contact or proximity to Neodymium magnets.

For Isotropic rubber magnets: loss of magnetization following exposure to temperatures over 80˚C, demagnetization due to contact or proximity with Neodymium magnets.

Obvious damage or alterations to the goods must be communicated to the supplier in writing at info@odbmagneti.com with any photo of the damaged product, within two weeks of delivery.

In general, claims and warranty claims are excluded for used products.

In the event of a guarantee, the supplier reserves the right to decide whether the goods are replaced or credited.

Replacement goods are generally shipped as soon as possible, with delivery costs borne by the supplier.

In case of failure to replace the goods, the customer has the right to withdraw from the contract or to request a reduction in the price paid. Other customer claims, in particular claims for damages, are excluded, unless they are caused by the supplier or by a third party commissioned with intent or negligence.
In case of acceptance by the supplier of the return, the Customer must properly pack the goods complete with the original packaging, sending them to ODB srl, via Appennini 28, 21034 Cocquio-Trevisago (VA) Italy carriage paid shipping costs to be paid by the sender.

10. Right of withdrawal

The Customer can exercise the right of withdrawal within 10 working days provided for by law, by communicating by e-mail to info@odbmagneti.com or by sending a registered letter with return receipt to ODB srl, via Appennini 28, 21034 Cocquio-Trevisago (VA) Italy.

Products made to measure for the customer are excluded from the right of withdrawal.

In the communication, the Customer lists in detail the items to be returned or replaced and sends the goods perfectly intact, correctly packaged in the original packaging, in such conditions that they can be resold, accompanied by a copy of the original invoice, to ODB srl, via Appennini 28, 21034 Cocquio-Trevisago (VA) Italy.

The shipping costs for returning the goods will be the sole responsibility of the customer. The Supplier will consequently reject any returned product not packaged correctly as indicated above, as well as products for which the shipping costs have not been fully paid by the Customer.

The Customer will communicate the bank details on which to support the payment of the returned goods, the Supplier will credit the value of the goods excluding the cost of transport and the collection costs of cash on delivery.

11. Treatment of personal data

Pursuant to and for the purposes of Legislative Decree no. 196/2003, the personal data that the Customer will freely communicate to us by filling in the questionnaire that he will find on the Site will be recorded on protected electronic and paper supports and treated in a completely confidential manner by ODB S.r.l. with logic strictly related to the execution of this contract.

At any time and completely free of charge, the Customer may consult, integrate, have their data modified or deleted, or oppose their use in whole or in part for the purposes set out in the previous point; to this end, the Customer must send a registered letter with acknowledgment of receipt to ODB srl, Via Appennini 28, 21034 Cocquio-Trevisago (VA) Italy or a fax to 0332 623867 or an e-mail to info@odbmagneti.com

12. Applicable regulations

For all legal relations between the parties, the law of Italian law applies. Any disputes relating to the interpretation and execution of these general conditions will be referred to the Court of Varese (Italy), expressly excluding any alternative court.
